They all now rely on the Land Registry’s computerised records. But we know that the deeds to a property are more important than that. They are its unwritten history. They are needed where disputes and queries are raised. Most importantly they are needed when someone dies. With Forever Safe you can store your Deeds with your Wills. One of the most frequent questions that we get asked is “Why do I need to store my Will; can’t I just keep it at home?” Some of our clients choose to do this, but the majority store their Wills with us. Normally when they hear about Gary.

 

Gary was a client who died in 2009, he was a wealthy man and had a long-term partner that he had lived with for over 20 years. He made a Will which benefited his partner and his partner’s daughter from a previous relationship. There were some smaller gifts to friends, but there was nothing for his parents and his sister because of an ongoing family dispute.

 

When he died, his partner did the right thing and asked his parents if they wanted anything to remember Gary by. His parents visited his home and took a few family items and left. Shortly after the visit of his parents it became apparent that Gary’s Will was missing, it had always been kept in his safe at home alongside his passport and that was missing too. What followed was shocking.

 

It started with a letter from a large firm of solicitors that alleged that Gary’s partner was interfering with his estate. It stated that his parents were entitled to the estate as he had destroyed his Will after resolving his dispute with the family. Everyone who knew Gary was certain this was untrue, but the parents produced his passport and a story about a family holiday as ‘proof’ of their story.

 

Gary’s partner went to court to dispute the parent’s story but a little-known aspect of the law – the presumption of revocation by destruction – helped the parents win the case. Gary’s partner then had to make a claim against the estate to keep the home that they had shared, she won that battle. Her daughter then made a claim which was partially successful and allowed her to live in a flat which Gary had owned.

 

However, the overall effect of the battles was far from what Gary had wanted – His partner got the house, but his parents got his fortune of about two and a half million pounds and of course the lawyers earned about £150,000 from the dispute.
